A SOUTHAMPTON gym facing legal action for allegedly breaching lockdown rules appears to be flouting covid restrictions again.
Based in Millbank Street in the Northam part of the city, Spartans is reported to have opened during the November lockdown.
Despite the city being classed as Tier 4, gym-goers could be seen walking in and out of Spartans Gym earlier today.
In November, Josh Gosling appeared at Southampton Magistrates’ Court accused of opening the gym during the second coronavirus lockdown.
He pleaded not guilty to two charges of failing to comply with reasonable instruction given by a relevant person in England.
Gosling, of Tickner Close, Botley, previously represented himself and protested his innocence.
He argued he is a passionate gym member and is neither the manager or owner of Spartans.
The council has confirmed it is aware the gym is open.
Councillor Jacqui Rayment, Deputy Leader and Cabinet Member for Customer and Organisation said: "The Council is working with the police to monitor activity at business premises, including Spartan’s gym.
"The Council has initiated a prosecution for breaches of the restrictions which occurred at Spartan’s gym earlier in the year. While in tier 4 and with case numbers rising, we ask the public to think about and to respect the restrictions in place."
The Daily Echo has contacted Spartans and Hampshire Police for comment.
