A DRIVER has been spared a ban after magistrates heard he would lose his home.
Maksymilian Krzysztof Nakoniczewski broke the speed limit on the westbound M27 on March 23 last year by driving a 16-reg Mercedes faster than 50mph in the roadworks section, near Eastleigh.
Nakoniczewski, 34, of Colby Street, Maybush, Southampton, was found guilty under the single justice procedure. The illegal speed was not available.
Basingstoke Magistrates Court could have disqualified him under the totting procedure but heard there were mitigating circumstances: he would lose his job, was the sole bread winner, his partner has just had a baby and they would lose their home.
Magistrates fined Nakoniczewski £400 with a £40 victim surcharge, £85 costs and imposed six penalty points onto his driving licence.
