A PROBE into a gym that opened during lockdown is ongoing.

Legal action against Spartans Gym, which opened during lockdown, has been dropped, but the business in Millbank Street could still be prosecuted, according to the city council.

Confusion surrounded who owns and manages the gym in the Northam ward of Southampton.

But documents uploaded to the Companies House website list Dean Little as the Company Director of Spartans Gym Southampton Limited.

A file received by the Government agency, states that he was appointed as a director on July 1 last year.

Josh Gosling, who previously described himself as a “passionate gym member” had been accused of opening the venue during lockdown.

He was charged with two counts of failing to comply with reasonable instruction given by a relevant person in England.

Nonetheless, during a hearing at Southampton Magistrates’ Court, he protested his innocence and stated he was neither the owner nor manager of Spartans.

He had been due to stand trial in March but the case against him was dropped.

Spartans was made the subject to a prohibition notice in November after being accused of operating during Tier 4 restrictions.

Throughout lockdown, gym-goers were spotted coming and going from the venue.

A previous statement from a council spokesperson said: “The council is currently investigating other lines of enquiry relating to the operation of Spartans Gym during the restrictions imposed by the health protection regulations in November and the enforced closure on 5 January 2021.

“This is likely to result in further legal proceedings and led to the decision not to proceed with the prosecution scheduled for this week. We are unable to disclose any further information at this time.”
