When officers arrived at the scene, they found a cyclist on the eastbound carriageway near Junction 1.
In a tweet, a spokesperson from Hampshire Roads Policing Unit said the cyclist "refused details and wanted to argue the law regarding pedal cycles use of the motorway".
The team posted dash-cam photo of the man cycling on the hard shoulder.
Aymer will appear at Southampton Magistrates Court on August 24.
