A MAN who kicked and punched his estranged wife’s new partner has been spared jail.
Jose Arroyo, also known as Ramon Navarro, was sentenced at Winchester Crown Court .
He denied assault causing actual bodily harm, but a jury found him guilty of attacking Derek Garside, 51. It took place outside the home of Navarro’s ex-wife, Jeanette Glennon in Stanmore,Winchester.
The court heard Navarro, 46, of Airlie Corner in Stanmore, punched and kicked his victim, but did not leave him with serious injuries. Francisca Da Costa, mitigating, said the assault was “out of character”.
Judge Andrew Barnett told him he decided against jail because of his previous good character.
He ordered Navarro to do 80 hours of community work, pay £500 costs, and gave him a 12-week jail term suspended for one year.
