ON Wednesday, June 6 we reported on the collapse of the court case against Solent yacht salesmen Roger Moon and Paul Heys.
The pair, who ran Hamble based broakerage firm Yacht Sales Limited, were accused of fraudulent trading.
We wish to clarify a number of matters in relation to the prosecution. The prosecution was seeking to proceed on one charge only and had abandoned all other charges against the two men. The case against the defendants was stopped for abuse of process.
While the judge did not consider that the officers dealing with the case at the time of the hearing were culpable, he was critical of the police delay, which he found to be unreasonable and a breach of the right of Mr Moon and Mr Heys to a fair trial. Mr Moon and Mr Heys were awarded their costs of defending the case.
Both Mr Moon and Mr Heys have at all times denied any unlawful conduct.
